A New York motorcycle accident doesn't have to wipe out your dreams

Here are some tips to follow to help minimize the stress and ensure you are protected at the scene of a motorcycle accident:
-      Remain at the accident scene. Leaving an accident scene can result in a charge of “hit and run” or “leaving the scene of an accident”.  Also, if you leave the scene of the accident, you are allowing the account of the other driver involved in the accident to be the basis for the police report. That means the other driver may place 100 percent of the blame on you!
-      Call the police. It is essential to file a police report immediately following an auto accident so there is official documentation of what happened. Also, be sure to seek medical attention even if you feel fine. Remember, after a motorcycle accident you will be in a state of shock which will interfere with your ability to accurately assess the pain that you are feeling or the injuries that you sustained. Not seeking immediate medical attention may affect your ability to receive fair compensation for your injuries. Therefore, even if your injuries are not obvious at the time of the accident, be sure to have your condition checked by a medical doctor soon after the accident so your motorcycle accident attorney can help you recover the compensation you are entitled to and you can file your claim before the statute of limitations runs out.
-      Exchange information with the other motorist(s) involved in the accident. You will want to exchange driver’s licenses and vehicle registration papers with the other driver(s) and write down the following information: name, address, date of birth, telephone number, driver’s license number and expiration date, insurance company and contact information, and written description of the other vehicle (the make, model, year, license plate number and expiration date, and vehicle identification number).
-      Another important thing to do is preserve evidence of the motorcycle accident. Taking good notes and plenty of photographs will assist us as your attorneys in helping you receive sufficient compensation for your injuries and damages.
By following these tips, you will have the documentation and information needed to protect your rights as an injured victim.
           In the majority of motorcycle accidents involving another vehicle, the other driver did not see the motorcycle in advance of the crash. This can occur for a variety of reasons, from the size of the motorcycle to fatigue or inattention on the part of the other motorist.

         Victims who suffered financial losses as a result of a motorcycle accident often seek compensation from the negligent party. Financial compensation is intended to reimburse the victim for expenses such as:
  • Property repairs;
  • Lost income;
  • Medical expenses;
  • Lost prospects; and
  • Physical and psychological pain.
Motorcycle injuries are usually quite serious and therefore expensive to treat. Serious head and spinal injuries are common as are are broken feet, ankles and legs.
        A number of factors contribute to motorcycle accidents. Many are the result of some form of negligence. Some of the most common are:
Most traffic law violations that lead to motorcycle accidents involve an element of negligence. Drivers who speed, tailgate, change lanes improperly or fail to yield the right of way increase their risks of being in a collision with a motorcycle. If a traffic violation is cited at the motorcycle accident, victims can use this to build stronger claims against the negligent parties.
In most cases, vehicles involved in accidents with motorcycles fail to see the motorcycle prior to the crash. This is due in part to the fact that motorcycles are so much smaller than other types of vehicles. However, fatigue, distraction and inattention on the part of the other driver also can contribute. When any of these behaviors are proved to be the cause of a motorcycle accident resulting in property damage or injury, the victim may be entitled to compensation.
       Motorcycle operators who made the effort to make themselves conspicuous (keeping headlights on, wearing bright clothing and staying out of other vehicles’ blind spots) improve their chances of winning a personal injury claim.
